Статья посвящена анализу современных подходов к оценке допустимости доказательств в уголовном процессе в контексте соблюдения принципов уголовного процесса и критериев допустимости, сформулированных в науке уголовного процесса. По мнению автора исследования, сложившаяся ситуация, связанная с законодательной регламентацией представляется не вполне совершенной и требует изменений в части определения критериев допустимости и иных характеристик.</p></sec><sec><title>Цель</title><p>Цель. Исследование вопросов допустимости доказательств во взаимосвязи с соблюдением некоторых принципов уголовного процесса и обоснование законодательной регламентации включения правил проверки допустимости доказательств в действующее уголовно-процессуальное законодательство.</p></sec><sec><title>Материалы и методы</title><p>Материалы и методы. При проведении исследования использовались эмпирические методы сравнения, описания, интерпретации; теоретические методы формальной и диалектической логики. Частнонаучные методы: системное, грамматическое и логическое толкование. Специально-юридические методы: формально-юридический. Теоретическую основу исследования составили труды отечественных ученых-процессуалистов, а также результаты изучения и анализа материалов следственно-судебной практики.</p></sec><sec><title>Результаты</title><p>Результаты. Установлено отсутствие единообразия в понимании ключевых принципов уголовного процесса, таких как право на защиту и язык судопроизводства, влияющих на решение вопроса о допустимости показаний обвиняемого. Сформулирована необходимость законодательной регламентации правил проверки допустимости доказательств в уголовно-процессуальном законе.</p></sec><sec><title>Выводы</title><p>Выводы. Действующая правоприменительная практика испытывает необходимость в дополнительном толковании сущности принципов права на защиту и на участие переводчика, в том числе при решении вопроса о допустимости в качестве доказательств показаний обвиняемого. Обоснована необходимость законодательного включения в уголовно-процессуальное законодательство правил проверки допустимости доказательств и предложена соответствующая редакция.</p></sec></abstract><trans-abstract xml:lang="en"><sec><title>Introduction</title><p>Introduction. The article analyzes modern approaches to assessing the admissibility of evidence in criminal proceedings in the context of compliance with the principles of criminal procedure and the criteria of admissibility formulated in the science of criminal procedure. According to the author of the study, the current situation related to legislative regulation does not seem to be quite perfect and requires changes in terms of determining the criteria for admissibility and other characteristics.</p></sec><sec><title>Purpose</title><p>Purpose. The study of the issues of the admissibility of evidence in relation to the observance of certain principles of the criminal process and the justification of the legislative regulation of the inclusion of rules for verifying the admissibility of evidence in the current criminal procedure legislation.</p></sec><sec><title>Materials and methods</title><p>Materials and methods. The research used empirical methods of comparison, description, interpretation; theoretical methods of formal and dialectical logic. Private scientific methods: systematic, grammatical and logical interpretation. Special legal methods: formal legal. The theoretical basis of the research was the works of Russian procedural scientists, as well as the results of the study and analysis of investigative and judicial practice materials.</p></sec><sec><title>Results</title><p>Results. The lack of uniformity in the understanding of key principles of the criminal process, such as the right to defense and the language of the proceedings, influencing the decision on the admissibility of the testimony of the accused, has been established. The necessity of legislative regulation of the rules for verifying the admissibility of evidence in the criminal procedure law is formulated.</p></sec><sec><title>Conclusions</title><p>Conclusions. Current law enforcement practice requires additional interpretation of the essence of the principles of the right to defense and the participation of an interpreter, including when deciding whether the testimony of the accused is acceptable as evidence.
