Стремясь обеспечить привлекательность своих юрисдикций, государства используют различные методы, направленные на повышение эффективности функционирования судов. На конкуренцию юрисдикций активно влияют политические процессы. Ярким примером воздействия политики на вопросы юрисдикции стал Brexit. Статья преследует цель рассмотреть актуальные вопросы, обусловленные выходом Великобритании из единого правового пространства ЕС, с точки зрения функционирования системы гражданского судопроизводства, последствия этих процессов для механизмов выбора юрисдикции. Посредством использования сравнительно-правового метода, изучены последствия процессов Brexit для российских компаний и перспектив развития российской юрисдикции, в том числе в связи с: а) сохраняющейся практикой разрешения споров между российскими компаниями или же российскими бизнесменами в Лондоне; б) новыми условиями конкуренции между британскими и европейскими, прежде всего французскими, судами за привлечение в свои юрисдикции; в) необходимостью разрешения споров по целому ряду актуальных вопросов, в том числе вызванных осложнением геополитической обстановки, затрагивающих государственные интересы России и интересы российского бизнеса; г) научным и практическим интересом для становления системы разрешения противоречий между компаниями стран СНГ в современных условиях. Использованы материалы британской и европейской правовой литературы, доклады Комиссии Совета Европы по эффективности правосудия, экспертные заключения российских и европейских юристов. Среди выводов – практические рекомендации по повышению конкурентоспособности российской юрисдикции, защите интересов России в юридической сфере. Обосновывается необходимость развития сотрудничества российской судебной системы с судами ЕАЭС и стран ЕАЭС, формирования системы судов по разрешению экономических споров, которые бы способствовали переводу значимых гражданско-правовых дел в российскую юрисдикцию или юрисдикцию ЕАЭС.</p></abstract><trans-abstract xml:lang="en"><p>One of the features of the modern model of interaction between legal systems is the competition between national jurisdictions. The states use different methods to improve the efficiency of their courts in order to make their jurisdictions more attractive. The competition between jurisdictions is actively influenced by political processes. A striking example of the impact of politics on jurisdictional issues is Brexit. This article aims to consider the topical issues caused by the UK's exit from the single legal space of the EU in terms of the functioning of the civil justice system, the consequences of these processes for the mechanisms of choice of jurisdiction. Using the comparative legal method, this article explores the consequences of Brexit for Russian companies and Russia’s jurisdiction, including in connection with: a) the continuing practice of dispute resolution between Russian companies or Russian businessmen in London; b) the new conditions of competition between British and European, especially French, courts for attraction to their jurisdictions; c) the need for dispute resolution on a number of pressing issues, including those caused by the complicated geopolitical situation. The materials used include UK and European legal literature, the reports of the Council of the European Commission for the Efficiency of Justice and expert opinions of Russian and European lawyers. The conclusions include practical recommendations on how to improve the competitiveness of Russia’s jurisdiction and protect Russia's interests in the legal sphere.
